So you are advocating for selective enforcement of the law? For example, a state will no longer grant same-sex marriage licenses. You would be fine with that?

Or, is there a political motivation for which laws should be enforced and which should not?

In practice, we've seen selective enforcement of the law for decades. White skin, money, and the right gender result in very different enforcement of the law than the enforcement experienced if you have black skin, no money, and the not-right gender.

Laws are selectively enforced at every level every day. Patrol officers decide who to pull over (if they know their vehicle codes they can find a reason to pull over pretty much any person they choose). District Attorneys are referred far more cases than they can prosecute so they choose which cases to pursue and which cases to drop. Judges use their discretion to dismiss or reduce charges all the time.

The forgoing are based on the priorities of the people, agencies, and offices involved. Cities and law enforcement agencies across the country are signaling that their priorities are not those of Mr. Trump and his supporters -- and why the hell should they be!

I encourage the local DA to drop prosecutions all the time (several times per week). About half of the time he agrees.

One thing I can do going forward is set each and every case involving non-citizens for jury trial. If every public defender does that we'll crash the entire system.

BTW: Do you recall Arizona SB1070? It was a law that authorized state and local law enforcement to detain people when there was a question of their immigration status. It was designed for state and local authorities to assist federal immigration agents in enforcing federal immigration law.

As I recall, you made the case the law was prohibited by the Supremacy Clause of the US Constitution. The Obama Administration made the same argument. The argument was only the US Congress could make national immigration policy. That by assisting federal authorities in enforcement of federal law; the state of Arizona was ďmakingĒ immigration policy.

In this case, the LAPD is saying they will impede federal authorities in enforcement of federal immigration law. Thereby, creating a new immigration policy in Los Angeles. This would seem to be in direct conflict with the Supremacy Clause which says federal immigration law takes precedence.

Can you explain your conflicting interpretation of the Supremacy Clause? Is this just another example of your double standard?

One interpretation of the Supremacy Clause when a Democrat is in the White House, but the exact opposite when the president is a Republican?

The new administration can indeed change federal immigration law (very different from a state trying to enact its own immigration law). However, that doesn't mean they can expect help implementing it from local and state authorities. If Trump wants to deport millions of people he's going to have to do so with federal personnel.

Yet another irony -- this would require the type of federal occupation force and concentration camps I thought conservatives were so opposed to.

Actually, Trump plans to use existing law as written. It is only the Obama Administration that tried to change the law by executive orders. (Which is why Obama's executive orders are now moving through the federal courts.)

Logically, the Trump Administration on day one could issue new executive orders that would rescind Obama's executive orders and render the court cases moot. It would also return enforcement of the immigration laws to what was written.

Second, I recall years ago during the Iraq War when the US Marines opened a recruiting station in Berkeley,CA. The city council wrote an open letter where they said the US Marines were not welcome in Berkeley. Further, they gave an anti-war group Code Pink a reserved parking space in front of the station where they could demonstrate and block the entrance to the station.

A local Congressman was incensed by this. He introduced a bill in the US Congress to withhold all federal dollars from Berkeley. The city council then wrote a second letter to “clarify” what the first letter said. The city council said they still opposed the Iraq War as is their right as citizens. But, they further said they supported everyone in uniform that serves in the nation's armed forces.

Hostilities to the Marines ended, Code Pink lost their parking spot and federal funding was restored.

The point: The LAPD and the city of Los Angeles are free to implement a policy of impeding federal enforcement of immigration law, but that does not mean the federal government must continue to send federal dollars to LA.
